Liability Blog Post

Go to www.nata.org/NATAnews Click on current issue. Use arrows to page 12 "The Athletic Trainer's Legal Liability for Football Related Injuries-Minimizing the Risk." Read article. Use arrows to page 20 "To Tape or Not to Tape: That is the (Insurance) Question." After reading the both articles, blog a response to the following questions.

  2. 1. I learned that Athletic Trainers have the highest liability risk regarding sports injuries because they have the closest contact with the team's players and is responsible for protecting their health and well being.

    2. To protect themselves, athletic trainers must have a great understanding of the "standards of care." They need to evaluate/test the athlete, document all injuries, clearly communicate with the athlete and the physician, and they need to thoroughly educate the athlete on techniques, treatment, what not to so that they don't make injury worse, and how prevent an injury all together.

    3. It is important for athletic trainers to have liability insurance so that they cannot be accused of being liable for an injury that was not their fault what so ever.

  3. 1.I learned that athletic trainers have the highest risk for sports medicine and that they are responsible for everybody in the team.

    2.For athletic trainers to protect themselves all they need to do is be organized and keep track of every injury. They also need to keep comunicating with all the athletes, parents, coaches, and physicians on what the injury includes.

    3.It is important so that the athletic trainer will not be accused or they will not be at fault for the injury.

  4. 1. I learned that athletic trainers have to be very carful with how they treat there patients when rehabilitating an injury.
    2. Athletic trainers already have liability insurance during school hours supplied by the school, but for events in other locations they can purchase there own liabilty insurance.
    3. If trainers dont have insurance then if a player gets hurt and the trainer lets them keep playing and injury gets worse they can end up with a lawsuit, and the the insurance protects them.

  5. 1.I learned that athletic trainers have the highest risk in sports medicine. They also have to be very careful when dealing with patients.
    2.To protect themselves they need to follow and understand the (standard of care)method. They also have liability insurance for school hours, not outside of school.
    3.It is highly important for an athletic trainer to have liability insurance so that they cant get in trouble for something they didn't do. Also it is important to choose a good insurance; such as pricing, and benefits.

    2. they need to keep track of every dingle injury and they should have liability insurance.

    3. they should have insurance in case of a lawsuit, the insurance protects them and they should pick carefully because they can get on policy for one price and get the same thing for cheaper.

  7. 1. I learned that trainers have the highest liability risk regarding sports injuries because Athletic Trainers are mainly responsible for an athletes health. They are closest with the Athletes,and they have the closest contact.

  9. 1. I learned that there is a huge risk of a liability when you are an athletic trainer. They are the ones who hold the most responsibility when an athlete gets injured.

    2. In order to protect yourself, the athletic trainer should know and understand all of the rules to being an athletic trainer.

    3. An athletic trainer should have liability insurance because it keeps them from getting a lawsuit. They should look into the benefits of all the insurances.

  12. 1. Through reading this article I learned that athletic trainers have the highest risk of liability because they are the ones who are closest to the athletes. This means they have to be always paying attention and have to be extra careful.

    2. Athletic trainers should first understand the "standards of care" to first protect themselves. They should also have liability insurance and be well organized. Athletic trainers should have good communication between coaches, athletes and physician in the event of an injury and record every injury and what you did to help it.

    3. It is extremely important to have liability insurance to protect the athletic trainer in the event of a lawsuit so they can be protected, especially when they did everything in their knowledge and power to try and help the athlete. It is important to consider the benefits and the pricing on insurance.

  13. 1. I learned that athletic trainers have a high risk of being sued from anybody. They have to have a personal liability insurance on top of the one they are given/offered with their job or profession. They also have to be careful on what they are doing.
    2. To protect themselves, athletic trainers can keep track of what the athlete asked for and papers when/if they go to the doctor. They also need to check symptoms the right way such as a concussion since if they send them back on the field, than it could cause a further injury.
    3. It is important that athletic trainers have liability insurance so they can protect themselves from being sued for all of their money. They must consider the benefits they are getting from that insurance as opposed to others.

    2. They need to keep track of injuries, know all they need to know about the patient, ask questions they need to know, and know the standard of care.
    3. It is important because people might go after you in court just to make money. An athletic trainer must think that any little thing could go to court so have good insurance.

  17. 1.)I've learned that athletic trainers have a higher liability then anyone else because they are the ones who are trained to take care of sports injuries.

    2.)Athletic trainers can do alot to protect theirselves. They can get all the paperwork needed from parents and keep track of them. Keeping records on injuries and anything bugging the athlete at anytime. Also having a emergency action plan can protect an athletic trainer.

    I learned that athletic trainers are extremely vulnerable to law suits because of many liability concerns and that trainers have to be careful when examining athletes at all times.



    2. What can athletic trainers due to protect themselves?

    Not only should athletic trainers have all the paper work on each athlete but when examining an athlete they should tell them exactly what they're doing and why they're doing it. When examining a more uncomfortable area of the body they should always have a witness.


    3. Why is it important for athletic trainers to have liability insurance? What must they consider when choosing insurance?

    Liability insurance will help protect the trainers against some unnecessary law suits. They should consider affordability and coverage when looking for an insurance policy.

  23. 1. I learned that Athletic Trainers have the highest liability risks. It is very important that Athletic Trainers are focused and careful with how they handle patients. Athletic Trainers are responsible for all the members of the team so they have to make sure they are doing proper rehabilitaion techniques for the whole team.

    2. Athletic Trainers have liability during school hours provided by the school, but when an Athletic Trainer is at an event or another location in order to protect themselves they need to purchase personal liability insurance. Also, Athletic trainers should be organized and prepared so nothing wrong happens& so there is no wrong information.

    3. It is critical for Athletic Trainers to have liability insurance so that if there was an inury the Athletic Trainer will not be accused or blamed for the injury. But if they dont have liability insurance and the player gets hurt because the Athletic Trainer told them to continue workouts and the player gets injured, it could cause a huge lawsuit. They should keep in mind that getting the best insurance will help in the long run.

  24. 1. After I read this article, I learned the importance in an athletic trainers job and how they need to be aware of what is going on around them. Since athletic trainers have become a popular target of lawsuits, a small mistake could easliy be used against them.

    2. Athletic trainers can protect themselves by having an understanding of "Standard of Care" in order to manage specific injuries. The althetic trainer can also learn from studying legal cases and first-hand experiences of those who had defended an athletic trainer during the ligitaion process.

    3. It is important for athletic trainers to have liability insurance because it could essentially assist the athletic trainer in court. Choosing the right insurance should have the right benefits for the athletic trainer.
